BAC into Q3 call with a $1.2B FinCEN/Treasury BSA hit — OCC $750M credited, OFAC $11.6M; >$5B in SARs missed

Post by LondonNewsTrader »

Awkward timing: Bank of America reports Q3 this morning with a fresh regulatory billboard on the tape.

What Treasury announced late Tuesday (FinCEN / OCC / OFAC, AP / CNBC / WSJ):
- FinCEN: $1.2bn civil penalty for willful BSA failures — third-largest in Treasury history
- OCC: record $750m civil money penalty for a deficient BSA/AML program (credited toward the FinCEN total)
- OFAC: ~$11.6m settlement on sanctions apparent violations (Iran, Russia, narcotics, terrorism programs cited)
- Bank admits it failed to maintain a compliant AML program, do foreign-correspondent due diligence, and file SARs
- Regulators say >$5bn of suspicious activity went unreported in a timely way, including Chinese money-laundering networks and southwest-border illicit finance
- BAC already under a Dec 2024 OCC cease-and-desist on BSA/AML remediation

For the print / call: this is a one-time P&L item more than a franchise story on day one, but the Q&A will get dragged into remediation spend, timelines, and whether any further consent-order risk is still open. Street EPS focus stays on NII, deposits and IB — treat the fine as an overhang on the first reaction, not the whole thesis.

Are you fading any BAC gap that looks fine-driven, or waiting for Moynihan on the call before touching it?
